Types

There are 2 types of sick leave, depending on the origin of the contingency causing the leave:

1- Common Contingencies

These are common illnesses or accidents. These situations occur completely unrelated to the work we perform and prevent us from developing it.

2- Professional Contingencies

These are work accidents or occupational diseases. A work accident is considered any bodily injury that the worker suffers on the occasion or as a consequence of the work they perform. And an occupational disease is considered.

Requirements

To be able to collect sick leave it is necessary to meet some requirements:

- Common illness: Be affiliated and in high or similar situation and have covered a contribution period of 180 days in the previous 5 years.

- Accident whether or not work-related and occupational disease: No previous contributions are required.

How long can I be on sick leave?

Sick leave can last 365 days, extendable for another 180 more days if it is expected that healing will occur within that period.

The benefit will be extinguished by:

  • By the passage of the maximum established period.

  • By medical discharge with or without declaration of permanent disability.

  • By becoming a pensioner.

  • By not showing up to the examinations established by INSS or mutual doctors.

  • By death.

How much will I collect while on sick leave?

It will depend on the type of leave:

- For common contingencies: From day 1 to 3, nothing is collected. From day 4 to 20, 60% of the regulatory base is collected. From day 21 onwards, 75% of the regulatory base is collected.

- For professional contingencies: 75% of the regulatory base is collected from the day following the leave.

The regulatory base is different for each person, as it depends on our contribution base for common or professional contingencies from the month prior to the leave.
