Who must file Form 115?
The following are required to file Form 115:

If the 20th falls on a Saturday, Sunday, or public holiday, the deadline is moved to the next business day.

How is the Form 115 withholding calculated?
The 19% withholding is calculated on the rent amount (taxable base):

Penalties for not filing Form 115
Failure to file Form 115 or filing it late can result in financial penalties:
- Fixed fine of €200 for not filing or filing late
- Proportional fine of 1% to 2% of undeclared withholdings (minimum €300)
- Surcharges for late filing: 5% to 20% depending on the delay
Additionally, the tenant (company or self-employed) cannot deduct the rent expense if withholdings were not correctly applied.
Withholding certificate
The tenant is obligated to provide the landlord with a withholding certificate within one month of the rent payment. This certificate must include:
- Landlord and tenant details
- Rented property (address and cadastral reference)
- Withholding base (rent amount)
- Percentage and amount of withholding
- Corresponding period
